Can my spouse and children stay in the UK under my post study work visa?
Individuals applying for a post study work visa to stay in the UK after completing study at an academic institution or college may be worried about whether their partner and children can also stay with them if their application is accepted. There is no need to worry, as partners and children of an individual applying for a postgraduate visa are also eligible to apply under the new UK government policy on immigration.
Making new friends and settling into a routine can be difficult for most people, but for children it can be even more of a challenge. By being able to stay in the UK under their parent’s post study work visa they will have no need to say goodbye to the friends they have made or to the school where they have been busy learning. If one parent has to stay to work in the UK and the rest of their family has to return to their original country of birth, this can be heart breaking for the individual left behind.
Applicants should submit a separate application for post study work visa for their children and spouse at the same time as submitting their own application. If this is done in person, it will cost £125, but it is only £100 if submitting it by post. Although you can submit any further applications for a visa after the named applicant has already submitted theirs, it will be much more expensive to do so. Indeed applying for a visa for a spouse or child separate from the main applicant could actually cost up to £475.
A different application form specifically designed for dependents and spouses needs to be filled out and supporting documents needs to be submitted to work permit consultants. This may include their passport and fee. It is important to note however that if the original applicant (for example the parent) has been in the UK for the past year they now need to prove they have at least £1,600 in funds available for each dependent. Evidence of this will need to be shown by submitting bank statements from the past three months.
An application for a spouse will need to be supported by submitting a marriage certificate or civil partnership certificate. In addition their passport must also be submitted including details of their immigration status and current UK visa situation.
If all the applications are successful, the family can continue working and studying in the UK for up to two years. Of course if their circumstances change during this time, they may move into a different visa category and immigration status which may alter the length of time they may stay in the country.
