Tier 1 Visa (Post-study work) PBS Assessment

The Tier 1 (Post-study work) category is designed to enable the most able international graduates who have studied here in the UK to continue working or to look for work without needing to have a sponsor

It effectively provides a bridge to highly skilled or skilled work. If you are granted permission to stay as a post-study worker, you will be expected to switch into another tier of the points-based system as soon as you can.

You can apply under Tier 1 (Post-study work) while here in the UK if you are:

• here with permission to stay under the Science and Engineering Graduates Scheme, the International Graduates Scheme or the Fresh Talent: Working in Scotland Scheme; or
• here as a student (which includes students, student nurses, students resitting examinations and students writing up a thesis).

If your UK student visa has expired – or will expire before you can satisfy all the rules relating to the Tier 1 (Post-study work) visa application - you should return to your home country and apply from there (UK Visas can still manage this for you).

What points you have to score to apply as a post-study worker

To qualify for a Tier 1 (Post-study work) visa you must score a total of 95 points as follows:

• 75 points for your attributes, which are a United Kingdom qualification, study at a United Kingdom institution, your immigration status during United Kingdom study and/or research, and the date of award of the qualification; and
• 10 points for English language; and
• 10 points for available maintenance (funds).

TIER 1 VISA, POST STUDY WORK VISA

A tier 1 visa, post study work visa is for non-EU nationals who are graduating from UK universities and seek transition to either a UK business or work visa. The tier 1 visa, post study work visa replaces the previous Fresh Talent: Working in Scotland and International Graduates Scheme.

The tier 1 visa, post study work visa covers a period of two years. The holder is then encouraged to transfer to another category of immigration, provided that they can generate enough points. They may also be eligible for transfer into the category that contains a tier 2 work permit. Those staying in the UK with a tier 1 visa, post study work visa are not contributing towards the time requirements that are needed for permanent residence.

Like other visas in the category, the tier 1 visa, post study work visa requires applicants to meet certain English language proficiency requirements. Candidates must also fulfil maintenance requirements that demonstrate their ability to support themselves whilst in the UK.

Applicants for a tier 1 visa, post study work visa are required to score no less than 75 points on the UK’s points-based system. The first requirement relates to education and is worth 20 points. This can be met by candidates completing a recognized UK bachelors or post-graduate degree. Alternatively, they may have gained a Professional Graduate Diploma in Education or HND from a Scottish institution.

The second requirement for a tier 1 visa, post study work visa - also worth 20 points – is that the qualification earned is from a recognized UK institution. If not, it must be included in the register of tier 4 sponsors. If the candidate for the tier 1 visa, post study work visa is obtaining a Higher National Diploma from a Scottish Institution, the institution in question needs to have been either a private or publicly funded institution of higher education with records of attendance and enrolment.

The third 20-point requirement is that the applicant’s qualification is gained while they are in the UK and in possession of a tier 4 student visa or as the dependant of a main recipient of a valid UK visa.

The fourth requirement for the tier 1 visa, post study work visa is worth 15 points. This requires the candidate to apply for the tier 1 visa, post study work visa within one year of obtaining their qualification.
