Tier 2 (Intra-Company Transfer)

The intra-company transfer category is for employees of multi-national companies who are being transferred by an overseas employer to a skilled job in a United Kingdom based branch of the organisation. There are now three new sub-categories:

• Established staff - must have worked for the overseas employer for at least 12 months and may apply for up to three years under Tier 2 (intra-company transfer).
• Graduate trainee - must be graduates and have worked for the overseas employer for 3 months and may apply for up to 12 months under Tier 2 (intra-company transfer).
• Skills transfer - must be graduates, do not need previous experience but may only apply for up to 6 months under Tier 2 (intra-company transfer).

To qualify for a Tier 2 (intra-company transfer) visa you must score:

• 50 points for your attributes (sponsorship, qualifications and future expected earnings; and.
• 10 points for English language if extending beyond three years) .
• 10 points for available maintenance (funds).

For initial applications the points are awarded as follows:

For the certificate of sponsorship

• 25 points

For qualifications

• 0 points for no qualification or under GCE A-level
• 5 points for GCE A-level or equivalent
• 10 points for a Bachelor degree
• 15 points for a Masters degree or PhD

For future expected earnings

• 0 points for earnings below £20,000 p.a.
• 10 points for earnings of £20,000 - £23,999
• 15 points for earnings of £24,000 - £27,999
• 20 points for earnings of £28,000 - £31,999

TIER 2 VISA, INTRA COMPANY TRANSFER VISA

A tier 2 visa, intra company transfer visa is for medium and highly skilled employees of multi-national companies who are being transferred to a branch of the company that is established in the UK. There are three different types of employee who might seek a tier 2 visa, intra company transfer visa.

A graduate who is working as part of a company’s graduate training programme may be transferred to a branch located in the UK. New recruits to a company may need to be transferred in order to see how other branches operate and to increase their knowledge of the company as a whole. Established staff may also be required to transfer in order to implement skills not found within the UK’s existing workforce. All three types of staff would require a tier 2 visa, intra company transfer visa.

Applicants who are granted a tier 2 visa, intra company transfer visa are allowed to live and work in the United Kingdom for the length of their employment or for three years. If the employee holds a tier 2 visa, intra company transfer visa for 5 years, then they may be able to apply for Indefinite Leave to Remain.

Once this is obtained, employees will be entitled to permanent residence in the UK and be able to travel without a UK visa in and out of the country. Indefinite Leave to Remain is a step towards obtaining full British citizenship.

Candidates for the tier 2 visa, intra company transfer visa must gain 70 points according to the UK’s points-based immigration system. These are obtained in a number of specific ways. Sponsorship by a multinational company will earn the candidate essential points to help them gain a tier 2 visa, intra company transfer visa.

Other points are earned by having a high level of education obtained through recognised universities, and being in possession of funds with which the candidates can support themselves whilst in the country. Intra-company transferees are automatically given points relevant to English language proficiency.

Candidates for the tier 2 visa, intra company transfer visa must be able to show that they have been working for the multi-national company for at least 6 months before they apply. They must demonstrate essential knowledge of the company and relevant experience. The UK-based receiving company must be owned by the applicant’s existing employer.
